      Oxnard City Council could Change

Fewer local candidates this year filed their papers for three open seats on the Council than in years past.  Seven individuals are on the ballot and seeking a spotlight on the main dais when the 2007 Oxnard City Council rolls in - here is the official line up.......

FOR MAYOR OF OXNARD

 • The Honorable Dr. Thomas Holden --- The current Mayor is completing his first term.
He is extremely capable and adept as a young, vibrant, and active Mayor.  Mayor Holden has a long history of service to the people of Oxnard and deserves a first look. Opponents want to bring his past record as Council-member into play to overturn his attempt for a second term. 
 
• A Most adept challenger - former Oxnard City Finance Chief - Phil Molina is considered the leading challenger.  Molina knows all the "in's and out's" and where some of the skeletons are buried. He will be considered the first runner-up as a candidate to unseat a popular first-term Mayor.
.makes an interesting opponent for incumbent Mayor Holden, who, according to critics knows where to find the shovel.
Robert Sumpter, in his second try for Mayor - a candidate dedicated to educating the
electorate and otherwise non-informed voting public.

FOR OXNARD CITY COUNCIL

 • The Honorable Mayor Pro-Tem, Andres Herrera. --- Herrera first ran for Council in 1992 and lost his re-election bid to = John C. Zaragoza in 1996.  He ran unsuccessfully for Mayor in 1998 and thereafter regained his Council seat in 2002. 
Interesting factoid:  Bill Winter and Andres Herrera both first ran for Council in 1992.  Herrera and Winter ran together again against seated Mayor Lopez for his center seat in 1998 and now in 2006 Winter and Herrera compete again, this time for a seat on Council.
 
• The Honorable Member of Council - Dean Maulhardt.  Being the only Republican Party affiliated member on the Council, Maulhardt holds an interesting place in Ventura County GOP politics as the only Republican on a Democratic Council. Council being non-partisan has no bearing on party affiliation, it's just interesting to note.   Never the swing vote, he always goes with the pleasure of the Council and seldom rocks the boat by his predictable vote.
 
• The top challenger, be it by default or good management is Bill Winter.  Winter has been a perennial on the ballot and has sought just about every seat inside the chamber.  He has a long history of involvement in the local political scene and would be the better choice for anyone not wishing to see Maulhardt or Herrera back on Council. He has wanted to serve Oxnard on the Council since 1992 and is stalwart in his desire to see Oxnard become Ventura County's primae urbis.
 
Francisco Romero is an artful and passionate young man whose vision for Oxnard includes a relaxing of the gang injunction based on civil rights concerns and a better respect for the Latino peoples who make up the majority of Oxnard's total populace.  Romero, in his first try for Council has to be a fast learner and realize that sewage projects, property issues, and some downright boring issues are decided by the Council and he will have to be a part of that should he win a seat.

Enrique Petriss also filed for Council - as did Al Velasquez.

  THE WHAT ABOUTS......

Questions are floating around town about some prominent candidates who are not appearing on this next ballot. 

Pretty much the public perception and speculation runs locally that the usual candidates expected to run in opposition to the incumbents were offered seats on the Planning Commission, and were told, in the room with no windows, that they were expected not to run for any Council slot this year.  MIA are Saul Medina, Dr. Irene Pinkhard, and most recently, Attorney Dierdre Frank who ran in the 2004 election and were subsequently  appointed to the Planning Commission by the seated Council in what some called a deal to keep them off the 2006 ballot.

Dr. Pinkhard is running for High School Board and thereby cannot run for any other office on the same ballot so her reason not to seek a seat on the Council is apparent. 
Saul Medina is staying steady on the Commission and being very beneficial to the City of Oxnard in his position on the Board.  Frank, who ran and against Tom Holden in 2004 and  came in a near second on the vote count  for Mayor is the most recent addition to the Planning Commission and her appointment was within weeks of the filing period for the 2006 ballot.

Both City Clerk and City Treasurer do not run for re-election this year, as do both Council-members Tim Flynn and John C. Zaragoza.  Their terms will expire in 2008 and re-election is the remedy to keep them in place two years from now.
 

 
  Another Sweet Heart Deal?

Quite awhile ago the City of Oxnard Council, staff members,
Planning Commission, and Parks and Recreation Department. laid the blocks to take 25 acres of your park land away from you the public to build a turn key
softball stadium for a private business, Big league Dreams.

Big League Dreams will get the open space, the five enclosed softball stadiums, batting cages and a covered pavilion and a sports bar that offers full range of alcoholic beverages in a "family environment." all for the low cost of  20 to 25 million tax dollars! You lose! "

Then Big League Dreams will sell tournament time to leagues mostly from other cities. You lose again! 

And guess what folks? You're going to pay for it! Corporate welfare?

As a tax payer of this City you should be outraged!!!

People write and complain about the streets, the golf coarse etc. etc., and  you should also be concerned that your park land and your open spaces that  are being given to big business!  Corporate welfare?

When the City of Oxnard and Big League Dreams are finished fleecing you with a  contract for 30 years, ( After 30, they  finally get their hand out of your pocket book) there isn't  going to be any money left for any other parks.

Quoting Councilman Dean Maulhardt:  "We are looking at a City wide assessment to cover the cost..." that means more tax money out of your pocket to pay for a private corporate entity. Corporate welfare again?

The current City Council is in favor of this public/private venture.
This deal with Big League Dreams an unadulterated hand out of your money and our park land. They get the park, 25 acres of open space, we pay for everything.  We can pay to watch, and pay to hang out at the bar!  (Might as well just make it a liquor store). Corporate welfare?

The City Council says Big League Dreams is for the kids?  
A full service bar has nothing to do with kids.  A shot of tequila with a beer chaser has nothing to do with kids?  Big league Dreams professes that they can't make it work unless they sell alcohol….what about the kids? 

Well, I guess if you want:  less traffic, better roads, more parks, and open space
for your families - get big business out of your pocket book
- - - - - - - - - - - - vote the incumbents out of office this  November.

This morning I received another legal victory in Molina v. City of Oxnard
in federal court.

Federal Judge Christina Snyder rejected the legal arguments of the City's
three attorneys. The City was represented by a group of seven, 4 staff
and 3 attorneys including City Manager Ed Sotelo, Assistant City Manager
Karen Burnham, City Attorneys Gary Gillig, Patty Kinaga, and Stephen
Katz, plus some other people whom I did not recognize.

The Judge told the City that their legal argument just was not correct
and not consistent with the normal process of the legal system. Judge
Snyder informed my attorneys Ms. Marisol Ocampo and Ms. Karen Larson from
the law firm of Century Law Group, that she would allow for us to further
augment my complaint consistent with the request that we had previously
submitted. The Judge was concerned about the amount of time that was
slipping away and informed everyone that she wanted to make sure that the
trial date of November 14th remains on calendar.

My attorneys and I were very pleased with the rulings today and feel that
perhaps the City might finally get the message from the Federal Court
that enough effort has been wasted by the City in making last ditch
attempts to derail the victory I received from the 9th Circuit Court of
Appeals.

Thanks to God, the hard work of my attorneys and each of you for your
good thoughts and prayers which resulted in this success.

The coming of a doughnut shop, Krispy Kreme,
should be noted because of the hoopla it created on its arrival in the great City of Oxnard.  With dismay and disbelief this citizen watched in amazement of the praise that came from the mouths of members of the city council..  And in today's Star,
August 12. 2006, the story of the departure of that doughnut shop is well reported on.

The important point to be made is while the doughnut shop is being praised - the city council-members were creating long term debt for the taxpayers.  Mr. Tom Holden spoke glowingly of Krispy Kreme all the while voting for the golf course subsidy (annually $900,000.00 and no audit) $13,000.000.00 for the unneeded four story parking lot garage.  The garage itself was built to accommodate the theatergoers and it is doing  poorly.
  
The theater was built with a guaranteed $1,600,000.00.
Without that guaranteed money from the city treasury the project could not find a lender. 

And along comes Big league Dreams.  A super million dollar fiasco in the making.  And thinking of fiascos let us not forget the Pacific Suns - a similar sweet-deal for a ball player consorteum.....Mr Holden and other councilmen voted for that one too.

By what name should the present councilmen be called with one exception. ----  How about boobs. or suckers.
All hail Krispy Kreme, Krispy Kreme is kaput in Oxnard.

In what would appear to be a move by the City Council to avoid the issue of making a re-zoning decision.  Mayor Pro-Tem Andres Herrera was the first to speak up on Council that the decision being asked of the Council that day could not be made due to a report, or section of the entire packet the Council needed for its review, was previously missing and had just appeared within 24 hours. That, according to Herrera and other Councilmen was unsatisfactory and therefore the Council had to table the decision and discussion on the item of re-zoning the Sports Park. 
Attendees had to fight for the right to speak on the issue - and said, had they known this item would have been pulled from the agenda, they would have spoken on it during public comments.

Hearing the pleas of the citizens, Mayor Holden, in a rare, but proper move, re-opened public comments allowing all in attendance to speak on "Items Not On The Agenda"

Mayor Holden modified the agenda by consent of City Attorney, Gary Gillig and the remainder
of the Council.

Several attendees who spoke about the proposal mentioned that the Planning Commission did them and Oxnard a disservice in making their decision based only on the available information they had - minus the missing report which the Council had just gotten hours before the convening of the June 20th meeting.

Somehow, in this mix, the Planning Commission should have reviewed this document and they approved the re-zoning without it.

As it stands - the re-zoning proposal will be placed on the agenda of a future Council meeting - maybe in July or perhaps August. 

This extra time will allow the Council to review all documents pertinent to the issue and will also allow residents time to re-group and re-think their strategy, to get more people out to speak up for what Oxnard needs desperately - and that is more open space for free recreation.

OXNARD DOES NOT NEED 100 MORE HOUSES...............

On June 20th,  the Oxnard City Council will accept or decline the offer of Centex Homes to develop and build 100 houses on top of land the City has zoned and declared a SPORTS PARK for the past two decades.

With a promise to the residents of Oxnard, and in particular, to those who recently bought new homes in the West Village neighborhood, the City has set aside this land for a sports park.  Even a park similar to the one that resides across from the Oxnard Airport on 5th Street is all the citizens are asking for. We just ask for open space and an area where we can play soccer and enjoy our community.

Centex, a major home developer is pushing all sides of the envelope to have this project approved. 
Centex has developments in more than 25 states in the continental US.  A few extra units put up in Oxnard is not going to break the financial back or future outlook of Centex - but - putting houses on this lot where our community was PROMISED and ZONED a sports park will break the collective will of our residents and ruin our future outlook as a community that is focused on the better life which so many have come to Oxnard to enjoy and live.

A warning goes out to any Councilmen who approve this - that your Centex will come to you in November 2006 or 2008 - whenever your next election is.  Because the 100 extra votes you cram into Oxnard's north end will not override the thousands that will come from voters who will not forget your breaking of a promise.

The City of Oxnard does have the money to buy this land for our use - it is just the leadership does not have the will to approve a park over the special interests of a developer --- so --- please join your fellow residents on Tuesday at City Council and send them a message.....

·         OXNARD COALITION TO SAVE THE SPORTS PARK AT CORNER OF OXNARD BLVD AND GONZALES ROAD. This item has been returned to the Oxnard City Planning commission. The following thoughts are by : FRANK BARAJAS, PROFESSOR AT CSUCI. Written in late June.

*            At the last Oxnard City Council meeting of June 20, 2006, I watched a contretemps regarding a hearing on the 20-plus acres of community reserve at the corner of Gonzales Road and Oxnard Boulevard. These twenty-plus acres of much needed sports park space is promised to the residents of Oxnard under the 2020 General Plan and the Northeast Specific Plan. After the dust settled, residents expressed their views on the Centex development controversy at this site. Below is a summary of points made by voting Oxnard residents regarding this problem.

 June 20th Public Comments on Items Not on the Agenda

 Ø      The Oxnard Planning Commission approved this project based upon incomplete information.

 Ø      The proposed Centex project would violate the Quimby Act. Legal recourse being considered.

 Ø      30 days advance notice must be given to Oxnard residents regarding any proposed amendments to the 2020 General Plan, specifically in relation to sports park space at Gonzales and Oxnard Boulevard.

 Ø      Members of the city of council are “too chummy” with land developers and have forgotten that they were elected to represent the best interests of Oxnard residents, not that of builders.

 Ø      Centex purchased the land at Gonzales Road and Oxnard Boulevard knowing that it is designated as community reserve park space under the 2020 General Plan. Therefore, the tail (Centex) seeks to wag the dog (the Oxnard City Council).

 Ø      There must be a moratorium on all residential development in the city.

 Ø      The City of Oxnard uses “Fuzzy Math” in Environmental Impact Reports to permit development.

 Ø      A selling point to homebuyers at the West Village neighborhood was a 20-plus acre sports park as promised by the 2020 General Plan.

 Ø      An email from a Centex employee arrogantly predicted the City Council’s approval of the project before a hearing was ever held. Shadow government in the works.

 Ø      Centex’s ploy to create a swimming pool on 9 gross acres of parks space—as opposed to the original 20-plus detailed in the 2020 General Plan—is designed to divide community opposition to the 100 unit residential development at an already heavily congested area.

 Ø      If the City of Oxnard approves Centex’s amendments to the 2020 General Plan and the Northeast Specific plan, the value of this parcel of land will rise dramatically making it virtually impossible for the city to purchase the land to realize the promise of a direly needed 20-plus acre sports park.

Did you read the "B" Section of the Star about how the entire City Council (all five of them) went on a field trip to talk about "a fashion retail center" for a project that hadn't even submitted a pre application?
                                                       Gosh, that used to be called 
"A VIOLATION OF THE OPEN MEETING LAW", aka the Brown Act, so:
1. When was the public notified about this closed session?
2. How did the Council members get to Rancho Cucamonga? Did they all take the same car? Did three of them go in the same car, which would mean that the going and coming were separate closed sessions?
3. What else did the Council talk about during this time, which creates another violation of the Act? OR, did they just sit in the same car but not say a word the entire two hour trip?
4. Why go on such a long "fact finding trip" when the 'Officials with RiverPark Legacy, heretofore called "the DEVELOPERS"  haven't and wouldn't even submit a "pre-application within 3 months" according the Matt Winegar?
5. Recall that the DA's attorney told jurors that "Convicting someone on a conspiracy charge isn't as complicated as it sounds". "It can be as simple as two people casually walking down the street agreeing to commit a crime like spray-painting a building and then taking steps toward accomplishing that goal, he said. "That's all you need in a conspiracy," --- Barrick told jurors." [From Star first page story "Taggers hit with felony charges".] Well than what do you call it when FIVE Council members agree to violate the Brown Act?

Oxnard Councilman Dean Maulhardt says he doesn't care much for shopping,
but that could change. Maulhardt joined Mayor Tom Holden and three other council members on afield trip Friday to Rancho Cucamonga, where they checked out Victoria
Gardens, a new 1.3 million-square-foot shopping center.
